Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your use of the PoshKit browser extension and this website (together, “the Service”). By installing or using the Service, you agree to these Terms. If you do not agree, do not install or use the Service.

2. What the Service is

PoshKit is a Google Chrome extension that adds tools to the Poshmark website to help sellers manage their own listings, including sharing, relisting, delisting, sending offers, changing prices, tracking profit, and saving message templates. It runs inside your own browser using your own existing Poshmark login.

3. Not affiliated with Poshmark

PoshKit is an independent product. It is not affiliated with, endorsed by, sponsored by, or in any way officially connected to Poshmark, Inc. “Poshmark” is a trademark of its respective owner and is used only to describe what the Service works with.

You are solely responsible for ensuring your use of the Service complies with Poshmark's own terms of service and policies. We do not control Poshmark, cannot guarantee the Service will remain compatible with it, and are not responsible for any action Poshmark takes regarding your account.

4. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. The Service is offered in the United States and Canada.

5. Your account and your conduct

You are responsible for your Poshmark account and for everything done through it, including actions you initiate using the Service. You agree not to:

• Use the Service on any account you do not own or are not authorized to operate.
• Use the Service to act on other sellers' listings.
• Attempt to circumvent the daily limits, confirmation steps, or pacing built into the Service.
• Resell, redistribute, sublicense, or reverse engineer the Service.
• Share a single subscription across multiple people or businesses.

6. Free trial

New users may start one 7-day free trial of the Pro features. The trial does not require a credit card. Trials are limited to one per person. At the end of the trial, Pro features stop working unless you subscribe. Message Templates and the Stats overview remain free.

7. Subscription, billing, and cancellation

Pro access costs $15 USD per month and renews automatically each month until cancelled. Payments are processed by ExtensionPay (extensionpay.com) using Stripe. We do not receive or store your card details.

You may cancel at any time through the billing portal linked in your receipt. When you cancel, you keep Pro access through the end of the billing period you have already paid for, and you will not be charged again.

If we change the price, we will give notice before the change applies to your subscription, and you may cancel before it takes effect.

8. Refunds

If you are not satisfied, email PoshKitExtension@gmail.com within 14 days of a charge and we will refund that charge in full. Refunds are issued to the original payment method. Because a free 7-day trial is available before any charge, we may decline repeated refund requests from the same person.

9. Availability and changes

PoshKit depends on the Poshmark website, which is operated by a third party and can change at any time without notice. Such changes may temporarily or permanently break some or all features. We will make reasonable efforts to keep the Service working, but we do not guarantee uninterrupted availability or continued compatibility.

We may add, modify, or remove features, and may discontinue the Service. If we discontinue the Service entirely, we will stop billing active subscribers and refund the unused portion of the then-current billing period.

10. Your data

The Service stores your templates, Profit Tracker entries, and settings locally on your own device. We do not collect, transmit, or store this data. See our Privacy Policy for details.

11. No warranty

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that it will produce any particular sales, revenue, or business result.

12. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost sales, lost data, or loss of listings, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose.

13. Termination

You may stop using the Service at any time by uninstalling the extension and cancelling your subscription. We may suspend or terminate access if you breach these Terms, including sharing a subscription or abusing the trial system. If we terminate your access without cause, we will refund the unused portion of your current billing period.

14. Changes to these Terms

We may update these Terms. If we make a material change, we will update the “Last updated” date above and post the revised Terms at this link. Continuing to use the Service after a change means you accept the revised Terms.

15. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Fresno County, California.
